The mediator meets with you individually first via an online platform, this is to give you the opportunity to explain the situation and discuss any particular concerns you have. This is also where an agreement is made to keep the conversations private and any necessary ground rules are discussed and agreed.
The mediator then brings you together for a joint online meeting. The mediator makes sure that you each get a chance to talk about your situation or point of view without any interruption. This helps you decide what the important issues are that need to be discussed.
These issues are discussed and if you reach an agreement the mediator will write it down for you and make sure it says what you both want it to say. Everybody signs the agreement and you decide who else, if anybody, should see a copy. If you are uncomfortable with sharing the joint agreement with people who are not in the room then a decision is made about what, if anything, to share with the person or people who referred you to mediation.
You don’t have to reach an agreement. If you feel that mediation won’t resolve your issues, you can use other workplace approaches, policies or procedures. Whether you reach an agreement or not, the mediation process will remain confidential. Neither the mediator nor anything discussed in the online meetings can be called upon or used to provide evidence at any subsequent proceedings.
No. You are encouraged to talk through your differences of opinion, differing views and your different expectations. The mediator will ensure a robust, fair and impartial process to enable you to reach a good outcome that works for both of you. Mediation helps you to move forward together.
Yes. The mediator will keep everything that you say during the mediation private, they will not take any notes away from the meeting with them and do not record or report back on the content of your conversations.
At the beginning of the mediation you are asked to sign a Confidentiality and Liability Agreement. This document also reminds you that the mediator cannot give legal advice and that the content of the mediation discussion is confidential, it cannot be used in any future processes or procedures that you may be involved in.
No. Mediation is a voluntary process, if you are unsure about whether or not you will attend, please speak with the person who has referred you for mediation. If you would prefer, you can also speak with a mediator from Consilia Mediation who will be able to answer any questions you have and hopefully allay any fears.
The mediator will lead the meeting. Usually there are just two people involved, though sometimes there are several, you will know who you are meeting with. The process does not allow for legal representatives, union representatives or any other representatives to be present during the individual or joint online meetings.
As the session is online, you do not need to bring anything with you to the mediation and you will not be asked to present evidence or explain the events that have led to mediation in detail. You will not be taking notes or recording anything during the meetings. The best preparation you can do is to think about what you want to say to the other person, what you want them to understand about the situation and what a good result from the mediation would be for you. Also, it can be a difficult and tiring process, so try to present with plenty of energy and with as few distractions as possible for the day ahead.
The thought of a joint online meeting with the person you are not getting along with can be worrying, however, mediation is less difficult and time-consuming than going through a formal process, and it works. It works because it helps people find practical solutions that feel fair to everyone. The mediator’s role in this joint meeting is to help you have a different kind of conversation with each other in a safe space, and to help you focus on what you need. The mediator holds both of you to the ground rules and makes sure you have equal time to speak and to listen to each other.
Mediation focuses you both on finding a collaborative way forward.
We do hope that your mediation session will prove to be as positive an experience for you.

Finding good legal advice and an empathetic approach is essential when the situation you are dealing with is emotionally fraught. I couldn't have asked for more from Consolia. Listened carefully, provided options and strategies and made me feel they were looking after my interests not their own. Quick, efficient and effective communications. No hesitation recommending Andy and the team in Leeds.
Very professional and got the right result for me in a very timely abs efficient manner. Great service, good advice and an excellent result I couldn’t have got on my own
Working with Andy Boyde was just what I needed, a person who could respond quickly, professionally and get to the crooks of the matter and explain in plain English what it all meant and what we needed to do.
Great experience and customer service just when you need.
I would highly recommend Andy and Consilia to anyone.

She has always responded professionally and promptly we couldn't of asked for any better thank you from the both of us.

Laura Clapton has been brilliant and very professional through the Mediation process. I highly recommend her.
Received a really good service from Marie and the team including Emma, who offered valuable support throughout. I contacted Consilia following a recommendation from a union representative. Was given great advise through her trusted associate who offered an accurate and professional assessment. Marie secured a really good outcome due to her knowledge, perseverance, conscientiousness and genuine desire to try and get the best outcome on my behalf. A lot of genuine empathy and respect expressed and a brilliant negotiator. Very well informed, experienced and brilliant communicator. True to her word re costs as discussion was upfront and honest. Very reasonable rate compared to other firms. Would recommend to others Thank you very much!

Marie and her team are brilliant. They are always professional whilst being personable and great fun to work with. Their updates during the Coronavirus Pandemic have been a lifesaver. Would definitely recommend!
I would have no hesitation in recommending Consilia Legal. Being in the more than capable hands of Marie & Andy collectively, helped me through an employment issue, which was difficult at times. However the support I received was highly proffessional, with a very caring approach at all times & they guided me through the process. Thank you so much. Elaine
Consilia have done a good job of mediating the discussions across family and financial matters. Quick responses, good communication and a helpful/flexible approach.
Thanks Laura and team at Consilia Legal. Great service and such a pragmatic and human approach to the legal system. Fitted really well with my personal values. Truly aimed at being conciliatory rather than adversarial.
I could not recommend Emma enough. As someone who is pretty clueless about legalities, Emma ensured everything was explained both concisely and with sufficient detail. Emma always made herself available when I had questions and was professional at all times. I would without a doubt use Consilia Legal again especially Emma - she is an asset to the company! Thanks again 🙂
If you need expert, pragmatic, timely employment law advice that you can trust then I highly recommend Marie Walsh and her team. When faced with a tricky issue full of 'shades of grey', Marie guided us through the process, step-by-step providing both an approach and letter templates. She was with us every step of the way, checking with us after every meeting, and discussing the next step. Alongside this, vitally for us, she understood our values and our commitment to not only complying with law, but also doing what's 'fair' and 'right' for all parties. Highly recommended.
Marie and Matthew have been so professional through knowledge and understanding. Would recommend to anyone needing their expertise.
Sarah Manning was great - really efficient and supportive. I would recommend her to anyone.
When my autistic son was suspended from work, we felt he had been treated unfairly in the workplace because of his disability and needed help and advice from a specialist employment lawyer. Consilia Legal were highly recommended to me.
I dealt with both Marie and Vicky and I can honestly say they were both amazing. They were both very professional and caring.
Initially, I was worried that I would find speaking to a solicitor confusing and complicated but they simplified things so I was able to gain a better understanding of employment law.
Vicky then delt with my son’s case and I felt we built a very good relationship. She was so easy to talk to and I found her very approachable, which made me feel very comfortable.
Because of my son’s disability, our aim was to seek a quick and satisfactory resolution rather than a lengthy, damaging conflict. Vicky was always there to advise me on the best course of action to resolve the dispute as quickly as possible and to help us achieve a positive outcome (which we did).
Thank you Vicky for all your help.
Highly recommend this team that punches well above its weight. Good leadership, communication & advice. All round pleasure to work with. Have known them for over 6 years and would use them every time.
Spoke with Andy Boyde for some legal advice, he couldn't personally help me with my case, however he spent 20 minutes of his time on the phone with me offering advice and he followed up by sending me an email with very helpful information.
I would highly recommend Andy, he was professional and very helpful even when the situation wasn't benefitting himself or the business he worked for, so I can only imagine his level of service if it was.
Professional and received good customer service. I would really recommend them as they helped me to negotiate my way out of a difficult work situation on the best terms possible. Andy was very polite and knowledgable.
I'd like to take the opportunity to say a big thank you to Andy Boyde for helping me with my employment issue. For someone who was in a difficult situation his knowledge and expertise helped guide me through the process. He always provided quick responses and was readily available to provide expert advice whenever I needed it. I was impressed with the knowledge and professionalism shown and would recommend him if you are ever in a complicated employment situation.
